Terms of Service

1. General Provisions

  1. These Terms of Service ("Terms") govern your use of the PodDigest service, available at podsumujpodcast.pl.
  2. The service is operated by DMC Filip Olender, ul. Lamparcia 10A, Lochowo, Poland, NIP: 5542813570, REGON: 526888290, email: kontakt@podsumujpodcast.pl ("Provider").
  3. By using PodDigest, you agree to these Terms. If you do not agree, please discontinue use.

2. Service Description

  1. PodDigest provides:
    • AI-powered summarization of podcasts and YouTube videos in various formats (TL;DR, action items, flashcards, fact-check, and more),
    • email subscriptions for automatic podcast channel digests,
    • summary history management within your account.
  2. Basic features are available for free with daily limits. Extended features require a paid plan.
  3. The Provider reserves the right to modify limits and plan features with prior notice to users.

3. Account and Authentication

  1. Registration is performed through Google Sign-In. By registering, you consent to sharing your email address and name as necessary to provide the service.
  2. You are responsible for maintaining the security of your account and must not share access with third parties.
  3. You may delete your account at any time by emailing the Provider.

4. Plans and Pricing

  1. Free plan— available at no cost with daily limits as specified on the Pricing page (up to 3 summaries/day, 1 fact-check/day, basic templates).
  2. Pro plan— 29 PLN/month or 249 PLN/year (9 USD/month or 79 USD/year). Includes: 15 summaries/day, all templates, 3 fact-checks/day, 30-day history, up to 3 email digests.
  3. Ultimate plan— 59 PLN/month or 499 PLN/year (19 USD/month or 149 USD/year). Includes: unlimited summaries, unlimited fact-checks, full history, up to 10 email digests, bulk summarize (up to 25 videos).
  4. Business plan— 149 PLN/month or 1 249 PLN/year (49 USD/month or 399 USD/year). Includes: everything in Ultimate plus unlimited email digests, bulk summarize (up to 50 videos), priority support, VAT invoices.
  5. Payments are processed by Stripe. Subscriptions renew automatically at the end of each billing period.
  6. You may cancel your subscription at any time from your account settings. After cancellation, paid features remain available until the end of the current billing period, after which your account reverts to the Free plan.
  7. If the Provider is unable to provide the service due to its own fault for more than 72 hours, you are entitled to a proportional refund.

5. Right of Withdrawal (EU Consumers)

  1. EU consumers have the right to withdraw from a distance contract within 14 days without giving any reason, in accordance with Directive 2011/83/EU.
  2. By subscribing to a paid plan, you expressly consent to the immediate provision of the digital service before the withdrawal period expires and acknowledge that you thereby lose your right of withdrawal, pursuant to Article 16(m) of Directive 2011/83/EU.
  3. If you cancel within 14 days of purchase and have not yet used any paid features (i.e., you have not generated any summaries under the paid plan), you are entitled to a full refund.
  4. Withdrawal requests should be sent to the Provider's email address.

6. Acceptable Use

  1. You agree to use PodDigest lawfully and in accordance with these Terms.
  2. The following is prohibited:
    • submitting illegal content or content that infringes third-party rights,
    • automated querying that bypasses rate limits or compromises service stability (scraping, bots),
    • circumventing limits by creating multiple accounts,
    • using the service to generate misleading or harmful content.
  3. The Provider may suspend or terminate accounts that violate these rules, immediately in cases of severe violations.

7. Intellectual Property and AI Disclaimer

  1. All rights to the PodDigest service, its design, and source code belong to the Provider.
  2. Generated summaries are provided for your personal use. AI-generated content may contain inaccuracies or errors. You should verify important information independently.
  3. You are responsible for ensuring that the URLs you submit do not infringe third-party rights.

7a. Use of AI Technology

  1. Automated processing: The service uses artificial intelligence (AI) models to generate summaries and analyses of audio/video content. This process is fully automated with no human review of the generated content.
  2. Technological limitations:You acknowledge that AI technologies may generate information that is incomplete, imprecise, or factually incorrect (so-called "hallucinations"). The service does not guarantee 100% accuracy or completeness of generated summaries.
  3. No professional advice: AI-generated content is provided for informational and reference purposes only. The service does not provide expert advice, and generated summaries do not replace listening to the original source material.
  4. Verification of content: You are responsible for independently verifying key information in generated summaries against the original source material, especially if you intend to rely on it for professional or educational purposes.
  5. Data privacy: To generate summaries, content you submit (links or files) is sent to third-party AI model providers. You consent to this processing in accordance with our Privacy Policy.
  6. Liability for AI content: The Provider is not liable for any damages arising from reliance on AI-generated information. Decisions made based on such content are your sole responsibility.
  7. Source content: Summaries reflect the content of original audio/video materials and do not represent the opinions or positions of the Provider. Responsibility for opinions expressed in original materials rests with their authors.

7b. Copyright and Opt-Out Procedure

  1. By submitting a link or file to the service, you represent that you have the right to process the material or that the material is publicly available.
  2. The Provider processes materials solely for the purpose of providing the service (generating summaries) and does not claim copyright over source content or generated summaries.
  3. Opt-out procedure for content creators: If you are the author or rights holder of a podcast or recording and do not consent to your content being processed by the service, please email kontakt@podsumujpodcast.pl with the channel name or link. The Provider will block processing of the specified content within 7 business days.
  4. The Provider follows a Notice and Take Down procedure — upon receiving a substantiated copyright infringement claim, the identified content will be promptly removed from the service.
  5. The service is not responsible for the content of podcasts and recordings processed at the User's request. Such content is not owned by the service and the service has no influence over it.

8. Limitation of Liability

  1. Summaries are informational only. The Provider is not liable for decisions made based on AI-generated content.
  2. The Provider is not liable for service unavailability due to causes beyond its control (infrastructure failures, force majeure).
  3. The Provider's total liability is limited to the fees paid by you in the preceding 3 months.
  4. Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for fraud or willful misconduct.

9. Complaints

  1. Complaints should be directed to: kontakt@podsumujpodcast.pl, including a description of the issue and the date it occurred.
  2. The Provider will review complaints within 14 days and notify you of the outcome by email.

10. Termination

  1. You may delete your account and stop using PodDigest at any time.
  2. The Provider may terminate your account for cause with 14 days' notice, or immediately in cases of severe violations of Section 6.

11. Changes to These Terms

  1. Account holders will be notified by email of any changes at least 14 days in advance.
  2. Continued use of the service after the notice period constitutes acceptance of the updated Terms.

12. Governing Law and Disputes

  1. These Terms are governed by the laws of Poland. For EU consumers, mandatory consumer protection laws of your country of residence apply where they offer greater protection.
  2. Disputes shall be resolved by the court having jurisdiction over the Provider's registered office.
  3. EU consumers may use the Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.
